3. No professional relationship

Any information provided through the Site, including articles, resources, service descriptions, blog posts, or other content, is intended for general informational purposes only and should not be relied upon as professional cybersecurity, legal, financial, or technical advice applicable to your specific circumstances.
A professional consulting relationship with DarkSun Solutions is established only after both parties have executed a mutually signed written agreement, such as a Master Services Agreement (MSA), Statement of Work (SOW), Engagement Letter, or other written contract defining the scope of services to be provided.
Until such an agreement has been fully executed, DarkSun assumes no obligation to provide consulting services, cybersecurity advice, or ongoing support, and no duty of care, fiduciary duty, or other professional obligation shall arise from your use of the Site or your communications with us.
Any recommendations, discussions, or preliminary conversations that occur before the execution of a written agreement are provided solely for informational purposes and should not be interpreted as formal consulting advice or relied upon for business, operational, or security decisions.
4. Consulting services
DarkSun Solutions, Inc. provides professional cybersecurity advisory and consulting services for information technology (IT), operational technology (OT), and related security environments. Information presented on this Site is intended solely to describe our capabilities and service offerings and does not constitute a commitment to perform services for any individual or organization.
All consulting services provided by DarkSun are governed exclusively by the terms of a mutually executed written agreement between DarkSun and the client. Such agreements may include, but are not limited to:
- Master Services Agreements (MSAs)
- Statements of Work (SOWs)
- Proposals accepted in writing by both parties
- Engagement Letters
- Other written service agreements executed by authorized representatives of both parties
These agreements define the scope of services, deliverables, responsibilities, timelines, fees, payment terms, confidentiality obligations, and any limitations or exclusions applicable to the engagement.
In the event of any conflict or inconsistency between these Terms and Conditions and the terms of an executed written agreement governing a consulting engagement, the executed written agreement shall control with respect to that engagement.
Nothing contained on this Site shall be interpreted as modifying, supplementing, or superseding the terms of any executed agreement between DarkSun and its clients.
5. Intellectual property
All content, materials, and intellectual property available on or through this Site, including but not limited to the DarkSun Solutions name, logo, branding, website design, text, graphics, images, icons, videos, software, documentation, assessment methodologies, consulting frameworks, templates, reports, research, processes, proprietary workflows, AI-assisted technologies, and all other content or materials (collectively, the "Content") are owned by or licensed to DarkSun Solutions, Inc. and are protected by applicable United States and international intellectual property laws.
Except as expressly authorized in writing by DarkSun, nothing contained on this Site grants or should be interpreted as granting any license, ownership interest, or other right to use, reproduce, distribute, modify, publish, display, create derivative works from, or commercially exploit any Content.
You may access and use the Site solely for your own lawful informational and internal business purposes. Nothing in these Terms transfers ownership of DarkSun's proprietary methodologies, assessment frameworks, processes, AI technologies, software, or other intellectual property. All rights not expressly granted herein are reserved by DarkSun Solutions, Inc.
6. Artificial intelligence
As part of our commitment to delivering efficient and high-quality cybersecurity services, DarkSun Solutions may utilize artificial intelligence ("AI") technologies to assist our consultants in performing certain internal business and consulting functions.
AI-assisted technologies may be used to support activities such as:
- Organizing meeting notes and documentation;
- Summarizing technical information and research;
- Drafting reports, findings, and recommendations;
- Reviewing documentation and assessment artifacts;
- Supporting internal analysis and knowledge management; and
- Improving the consistency and efficiency of cybersecurity assessments.
DarkSun uses AI as a tool to assist our consultants — not as a replacement for professional judgment. Unless otherwise agreed in writing, all client-facing deliverables, recommendations, assessments, reports, and other work products are reviewed and validated by qualified DarkSun personnel before being provided to clients.
DarkSun does not rely solely on AI to make professional cybersecurity decisions or recommendations. Final conclusions, findings, and deliverables remain the responsibility of DarkSun and are subject to human oversight and professional review.
Nothing in this section guarantees the use of AI for any particular engagement or service. DarkSun reserves the right to determine the tools, technologies, and methodologies used in delivering its services, provided they are consistent with the applicable written agreement governing the engagement.
7. Confidential information
DarkSun Solutions is committed to protecting confidential and sensitive information entrusted to us by our clients. However, the public portions of this Site, including contact forms, general inquiry forms, and email addresses published on the Site, are not intended for the submission of confidential or sensitive information unless specifically requested by DarkSun as part of an active consulting engagement.
Unless expressly requested by an authorized representative of DarkSun, you should not submit or transmit through this Site or its contact forms any of the following:
- Passwords, authentication credentials, or encryption keys;
- Personally identifiable information (PII), protected health information (PHI), payment card information (PCI), or other regulated data;

- Your violation of any applicable law, regulation, or the rights of any third party;
